 The U.S. Supreme Court on Wednesday night blocked New York Gov. Andrew Cuomo from reimposing strict attendance caps at worship services in areas hit hard by the novel coronavirus. 

 The court ruled 5-4 to bar Cuomo from enforcing his Oct. 6 “Cluster Initiative” against houses of worship that sued to challenge the restrictions. The order was also the first in which Justice Amy Coney Barrett played a decisive role. 

Barrett, who was President Trump's third Supreme Court nominee, joined the court Oct. 27, after winning Senate confirmation following the Sept. 18 death of Justice Ruth Bader Ginsburg.

Newsmax is naming Joe Biden the winner of Michigan, Nevada, and Pennsylvania after those states officially certified their election results.


Newsmax has not yet called the entirety of the 2020 presidential race for former vice president Joe Biden, but expects to make a determination shortly after reviewing legal challenges made by the Trump campaign.


Pennsylvania announced Tuesday that it officially certified its election results, giving Biden the state’s 20 electoral college votes. Secretary of the Commonwealth Kathy Boockvar certified Biden’s 80,555-vote margin of victory, which was announced in a tweet by Gov. Tom Wolf.

Also on Tuesday, the Nevada Supreme Court unanimously approved that state’s election results, giving Biden Nevada’s six electoral votes.  


And on Monday, Michigan election officials certified Biden’s 154,000-vote victory there, though President Donald Trump and his legal team have challenged the election tallies.

Thus, consistent with Newsmax's policy of basing calls in contested states on official certifications, Newsmax is naming Biden as the victor over Trump in all three states.

Last Friday, Newsmax called Georgia for Biden after an initial recount found him the winner by over 12,000 votes. President Trump has asked for a second recount, which is underway.

The curfew marked the first statewide stay-at-home order since March and it will bar travel from 10 p.m. to 5 a.m, but essential workers are excluded.

Housing and Urban Development Secretary Ben Carson says he was "extremely sick" with the coronavirus, but President Donald Trump cleared him for the monoclonal antibody treatment he'd received himself. 

"President Trump was following my condition and cleared me for the monoclonal antibody therapy that he had previously received, which I am convinced saved my life," Carson said on his Facebook account.

"I was extremely sick and initially took Oleander 4X with dramatic improvement," Carson said. Oleandrin, a derivative of the oleander plant, is the medication that had been championed by MyPillow CEO Mike Lindell for the treatment of coronavirus.  

However, Carson added that he has "several co-morbidities" and after experiencing minor discomfort, his symptoms "accelerated" and he became "desperately ill."



Carson said he's convinced the monoclonal antibody treatment was what saved his life. 

"President Trump, the fabulous White House medical team and the phenomenal doctors at Walter Reed have been paying very close attention to my health and I do believe I am out of the woods at this point," Carson said, adding that he hopes "we can stop playing politics with medicine" 

"We must prioritize getting comparable treatments and care to everyone as soon as possible," said Carson. 

Trump in October credited his own recovery to antibody treatments from Regeneron Pharmaceuticals. The Food and Drug Administration last week approved Bamlanivimab, Eli Lilly's monoclonal antibody therapy, for emergency use. Regeneron's treatment has not yet received emergency use authorizations. 



"There are a number of promising treatments that need to be tested, approved, and distributed (sooner rather than later) so that the economy can be re-opened and we can all return to a semblance of normalcy," Carson said. 

He also urged people not to cause alarm by claiming there have been "dangerous shortcuts" involved in the development of a COVID-19 vaccine.

President Donald Trump’s legal team suffered yet another defeat in court Friday as a federal appeals court in Philadelphia roundly rejected the campaign's latest effort to challenge the state’s election results.

Trump’s lawyers vowed to appeal to the Supreme Court despite the judges' assessment that the “campaign’s claims have no merit.”

“Free, fair elections are the lifeblood of our democracy. Charges of unfairness are serious. But calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither here,” 3rd Circuit Judge Stephanos Bibas wrote for the three-judge panel.

The case had been argued last week in a lower court by Trump lawyer Rudy Giuliani, who insisted during five hours of oral arguments that the 2020 presidential election had been marred by widespread fraud in Pennsylvania. However, Giuliani failed to offer any tangible proof of that in court.

U.S. District Judge Matthew Brann had said the campaign's error-filled complaint, “like Frankenstein’s Monster, has been haphazardly stitched together” and denied Giuliani the right to amend it for a second time

(WISCONSIN - Republicans filed a lawsuit Tuesday asking the Wisconsin Supreme Court to block certification of the presidential election results even as a recount over Joe Biden’s apparent win over President Donald Trump is ongoing. The lawsuit echoes many of the same arguments Trump is making in trying, unsuccessfully, to have tens of thousands of ballots discounted during the recount. It also seeks to give the power to name presidential electors to the Republican-controlled Legislature).

Wisconsin state law allows the political parties to pick electors, which was done in October. Once the election results are certified (it's scheduled to be done Dec. 1), those pre-determined electors will cast their ballots for the winner on Dec. 14.


As the certification dates are created by the states themselves there is, in theory, nothing stopping them from missing their own deadlines. 


If that were to happen they would risk forcing Congress to decide whether a slate of electors in legitimate. 


This opens up the possibility that Republican-led state Senates could send Trump electors, in spite of how the state actually voted.

Conservative radio host Mark Levin criticized media coverage of election fraud lawsuits being brought by the Trump campaign on "The Mark Levin Show" Thursday. 

“There’s a lot of confusion here,” Levin said, noting that the media have changed their narrative from “there’s no fraud” to “there’s not enough fraud to matter.”

Levin attacks the latter point, saying “the quantity of fraud is not the test.”


"You have sworn affidavits by American citizens, also election officials, under penalty of perjury. You didn't have that in the Russia hoax case. You didn't have that in the Stacey Abrams case in Georgia; you've got it up the wazoo here! Once Raffensperger certifies the results, Trump's campaign will have two business days to request a recount since the margin is within 0.5%. That recount would be done using scanning machines that read and tally the votes and would be paid for by the counties, the secretary of state’s office has said.




The hand tally stemmed from an audit required by a new state law and wasn’t in response to any suspected problems with the state’s results or an official recount request. The audit was meant to confirm that the voting machines correctly tabulated the votes.

The hand count produced some  differences from the previous machine tally, but no individual county showed a variation in margin larger than 0.73%, and the variation in margin in 103 of the state’s 159 counties was less than 0.05%, the secretary of state's office said. During the audit, several counties discovered previously uncounted ballots and were recertifying their results.

Top economic officials are urging Congress to provide more aid to small businesses that have taken a hit due to statewide lockdowns amid the coronavirus pandemic.

Treasury Secretary Steve Mnuchin and Federal Reserve chairman Jerome Powell were back on Capitol Hill Tuesday, urging lawmakers to agree on another economic stimulus package.

While speaking to the Senate Banking Committee, Mnuchin said small businesses,are in dire need of assistance and could be helped by another round of funding to the Paycheck Protection Program, which helped bolster the economy earlier this year.

The President and I believe that restaurants had been unfairly targeted, and I’d urge Congress to support another $300 billion for PPP,” stated the secretary. “This would have a real impact…these restaurants need grants, they don’t need loans.”

Some of that money, he urged, could be repurposed from funds he’s clawing back from other Fed programs, which are set to expire at the end of the year. His decision to shut some emergency lending programs has sparked outrage from Democrats.

It particularly set off a testy exchange between the Treasury secretary and Sen. Sherrod Brown (D-Ohio) who accused the administration of sabotaging the economy as the President’s first term nears an end. However, Mnuchin fired back.

“My decision not to extend these facilities was not an economic decision,” he stated. “I’m surprised to hear Sen. Brown use words like sabotage, no legitimate justification, delusional, malpractice, time for action.”

Mnuchin reiterated that he’s within his rights to withdraw the money from the Fed’s control. According to reports, the CARES Act requires unused funds to be pulled back from the lending programs.

Despite not agreeing with the decision, Powell highlighted the importance of bringing much needed aid to businesses floundering during the pandemic.

“What we’re hearing is that there are a lot of small businesses that are at risk of going out of business during this winter, which could be a tough few months,” he stated. “There are parts of the economy that will need help or might need help to get that last span of the bridge in place to get to the other side of the pandemic.”

After weeks of deadlock, a bipartisan group of lawmakers have put together a new stimulus plan.

Treasury Secretary Steven Mnuchin on Tuesday contended that he was required by law to move $455 billion in unspent emergency pandemic relief money into an account. 

“It is my intent to completely follow the law, and the law requires the amounts transferred,” Mnuchin said during a Senate Banking Committee hearing in Washington.

Mnuchin has come under fire for demanding that the Federal Reserve return $429 billion in unused funds from the Cares Act in hopes it would help break the logjam on Capitol Hill over additional relief spending. That money, along with an additional $26 billion for company loans that the Treasury Department hasn’t spent, will be placed in the department’s general fund, which can only be tapped with congressional approval.

Treasury Secretary Steven Mnuchin requested that the Federal Reserve return unused coronavirus stimulus funds.

In a letter to Fed Chairman Jay Powell on Thursday, Mnuchin said the central bank held some $455 billion from the COVID-relief package passed back in March. The Treasury Secretary asked Powell to return that money so Congress can spend it on additional relief measures.






Treasury Secretary Steven Mnuchin said lawmakers should redirect unspent stimulus funding, including money he is pulling back from the Federal Reserve, to buoy the economy as the U.S. waits for a coronavirus vaccine.

"I hope that Congress will seriously consider reallocating $580 billion of funds that have already been appropriated that wouldn't cost taxpayers an additional penny," he said in a phone interview Thursday.

REP. Jordan and Rep. Comer of the Judiciary sub-committee request Judiciary and Oversight committee to Investigate Voter fraud



 







The two congressmen noted that they had released a report back in September “detailing how Democrats across the country were pushing last-minute changes to state election laws and procedures.” And Jordan and Comer said they had warned that those initiatives “would increase the risk of election-related crimes and errors.”

They added: “These serious concerns give rise to the urgent need for congressional oversight of the integrity of the 2020 election.”

President Donald Trump is claiming to have won the election and that “voter fraud” occurred “all over the country.” Rudy Giuliani, Trump’s personal attorney, is in charge of campaign lawsuits challenging the vote count.

This is headed to the Supreme Court.

President Donald Trump's path to 270 is so difficult, the more likely goal for his team is to keep enough states from certifying the election results so Joe Biden falls short of 270 electoral votes on the Electoral College date of Dec. 14.

"We're in a land of the unknown, and we just don't know how the Supreme Court would ultimately decide this case," Dershowitz told host Bob Sellers.
