A panel of federal judges in New York on Wednesday denied the Trump administration’s request to begin a program aimed at cutting back benefits for immigrants while a lawsuit over the plan plays out in court.

The ruling by a three-judge panel of the U.S. Court of Appeals for the 2nd Circuit keeps in place a nationwide halt on President Trump’s "public charge" rule that links immigrants’ legal status to their use of public benefits.

The three judges on the panel are all Democratic appointees. Judge Amalya L. Kearse was appointed to the bench by President Carter, Guido Calabresi by President Clinton, and Susan L. Carney by President Obama.

The order came after the Trump administration sought to implement the program while it appeals a U.S.-wide injunction entered by a federal district judge in New York. 

Two similar injunctions were lifted last month by the Richmond, Va.-based 4th Circuit and the San Francisco-based 9th Circuit. Despite those decisions, however, the injunction from New York, which falls under the 2nd Circuit, continues to apply across the country.

The Trump administration’s controversial approach to the public charge rule, announced in August, is one of a series of administration measures aimed at curbing legal immigration.

Under the policy, an immigrant would be considered a public charge — essentially dependent on government aid — if they receive at least one public benefit for more than 12 months within any three-year period. Benefits include Medicaid, food stamps, welfare or public housing vouchers. The Trump administration rule would also examine the likelihood of an immigrant using such benefits in the future. 

The rule, which represents a more stringent approach to a long-standing immigration law than those taken by recent administrations, is likely to make it harder for some immigrants to obtain a green card to reside permanently in the U.S.

The policy was quickly challenged in court, leading to several nationwide injunctions before it could take effect on Oct. 15.

At issue in the case is whether the Trump administration has the proper authority to expand the definition of who is considered a public charge.

A federal appeals court on Thursday lifted several injunctions that were blocking the Trump administration’s rule restricting immigration eligibility for individuals deemed likely to become public In its 2-1 decision, the Ninth Circuit Court of Appeals stayed preliminary injunctions against the administration’s rule from federal courts in Washington and California. 

(The rule is still blocked nationwide by courts in Maryland and New York, which the decision by the Ninth Circuit do not overturn). 

“Public charge” denotes immigrants who are likely to require government assistance, such as food stamps or Medicaid. The Trump administration had moved to restrict the number of new immigrants who would require such assistance, but several courts blocked the rule in October before it could take effect.

In its 2-1 decision, the Ninth Circuit Court of Appeals stayed preliminary injunctions against the administration’s rule from federal courts in Washington and California. The rule is still blocked nationwide by courts in Maryland and New York, which the decision by the Ninth Circuit do not overturn.

“The phrase [“public charge”] is subject to multiple interpretations, it in fact has been interpreted differently, and the Executive Branch has been afforded the discretion to interpret it,” wrote Judges Jay Bybee and Sandra Ikuta, both appointed by George W. Bush. “Whether the change in policy results from changing circumstances or a change in administrations, the wisdom of the policy is not a question we can review.”

The rules require officers to consider an expanded group of public benefits in deciding whether an applicant qualifies for a green card. Since most undocumented do not qualify for the newly added benefits, that change won’t have much impact. A bigger problem is that the rule requires a green card applicant to prove more financial resources than under current rules. Here’s the answer to some questions about the new rule.

Q, What is the public charge bar to permanent residence?

A. With some exceptions, such as for asylees and refugees, the law bars individuals who are “likely to become a public charge” from getting a green card. A public charge is a person who will require government funded need-based public assistance.

Q. How are the rules changing?

A. Under current rules, U.S. Citizenship and Immigration Services considers only cash-assistance benefits as a major negative factor when determining whether a green card applicant is likely to become a public charge. Under the new rule, immigration will consider almost all need-based federal benefits. Also, the rule requires increased proof that an applicant will not become a public charge, even if the applicant is not receiving public benefits.

Q. Are all green card applicants affected by the rule change?

A. No. The new rule affects only individuals interviewing for green cards in the United States, the process called “adjustment of status,” who have received certain public benefits. And, from among those applying to adjust status, exempt are refugees, asylees, special immigrant juveniles, applicants under the Violence Against Women Act and others applying under humanitarian programs.

Q. Which benefits do not count under the rule?

A. Among the many excluded are state or city-funded benefits, Medicaid for pregnant women, the WIC program (a supplemental food benefit for low to moderate income pregnant women, infants, and children) and student loans.

Q. When does the new rule take effect?

A. Applications filed on or after Oct. 15 will be considered under the new rule.

President Trump’s new “public charge” rules take effect Tuesday, Oct. 15, but since Monday is a federal holiday, and most post offices are closed on Sunday, Friday, Oct. 11, is the real cutoff for filing to be processed before the new rule.

The new rule applies to applicants for adjustment of status — the process of interviewing for your green card in the United States. It changes the rules for determining whether a green card applicant is “likely to become a public charge,” that is, to require need-based public assistance to live in the United States.

As I wrote last week, the new rule makes having received certain need-based public benefits a bar to getting a green card.

Though very few applicants qualify for these benefits, the new rules will nevertheless make it harder for you to get a green card.

In some cases, the new rule raises the amount your sponsor must prove they earn to show they can support you.

Under current rules the sponsor must prove support at the level of 125% of the federal poverty for a “family” that includes the sponsor, his or her dependents and the green card applicants.

The new rule allows USCIS, in some circumstances, to require proof of a sponsor’s income at 250% of the poverty level. Family and friends can submit supplemental affidavits to support the application, but many applicants will nevertheless find it harder to meet that threshold.The most frightening aspect of the new rule for green card applicants is the emphasis on USCIS officers considering the “totality of circumstances” in determining whether the applicant will become a public charge.

Even for applicants who have never received public benefits, the totality of circumstance’s test may be hard to pass.

Factors USCIS will consider include whether the applicant speaks English and has education and skills (factors in determining employability), whether the person has worked in the United States since getting employment authorization, the applicant’s age, health, and whether the applicant can get unsubsidized health insurance.

The message to USCIS examiners is clear: Find a way to deny applicants a green card.

In This War Minnesota’s Twin Cities Are Lost

After spending all of last week in Minnesota, UTT’s professional assessment of the enemy situation is this:  the cities of Minneapolis and St. Paul, Minnesota – known as the “Twin Cities” – are in enemy-held territory.  They are, at least for the time being, lost – meaning, they are under the control of a collaborative jihadist/marxist element there.

Background

The jihadi network in America is documented by UTT here, here and here, as well as in Raising a Jihadi Generation.

The Islamic jihadi network in the United States includes the most prominent Islamic organizations in America, as well as most of the 3,000+ Islamic Centers/mosques, all of the 700+ Muslim Students Associations (MSAs), all of the Islamic Societies and Islamic Associations (Hamas), and a large number of the Islamic non-profits created in 1993 forward.

The purpose of the Islamic Movement here – per their stated doctrine – is to wage Civilization Jihad until America becomes an Islamic State under sharia (Islamic Law).

One of the most popular junior high school text book in Islamic schools in the United States (Emmerick, Yahya, 1999, What Islam is All About, page 382) states:

“The duty of Muslim citizens is to be loyal to the Islamic State.”

Enemy Strength

Minnesota is home to the largest Somali population in America.  It is estimated that over 125,000 Somalis live there, most of whom are in the Minneapolis area.  This community sent at least 22 Islamic jihadi fighters overseas to fight for the terrorist group Al Shabaab, although some estimate the number is closer to four dozen.

The  Cedar Riverside neighborhood is also called “Little Mogadishu” in reference to Somalia’s capital.  Some Minneapolis residents feel parts of their city have become like a third world nation.

Inside a 10 mile radius of Minneapolis city-center, there are at least 29 Islamic Centers/mosques, and an unknown number of home-mosques.  The Twin Cities area is home to Hamas organizations including CAIR and Islamic Associations.  The Muslim Brotherhood’s Muslim Students Associations (MSAs) are on at least 21 Minnesota college and university campuses. There are MSAs in at least 11 Minnesota high schools recruiting jihadis and turning public opinion towards the Palestinian Cause (Hamas) and away from Israel.

Other Muslim Brotherhood (jihadi) organizations in and around the Twin Cities area include the Islamic Societies in Woodbury and Willmar, the Muslim American Society (MAS), and others.

The Twin Cities is home to the first official organization representing Al-Azhar University in Egypt -the Islamic University of Minnesota (IUM).  Al-Azhar is the oldest and most authoritative school of Islamic jurisprudence on the planet.  At IUM students are taught that killing Jews, waging jihad, and imposing sharia on the world are obligations for all Muslims.

Minneapolis and St. Paul are also home to the Minnesota Dawah Institute.  This Institute focuses on spreading Islamic Dawah, the call to Islam, a mandatory requirement before jihad can be waged.

As a result of this invasion of Minnesota, the average Muslim on the street wants to overturn U.S. law and live by sharia.  This includes the open support of killing people who mock Mohammad, Islam’s prophet.  For a realistic view, see the Ami Horowitz short video on the streets of the Muslim Cedar-Riverside neighborhood of Minneapolis, also known as the “West Bank” of the University of Minnesota, HERE.

Elected Leadership

Without exception, elected officials in the Twin Cities’ area have not only surrendered to local Islamic leaders, they are using the force of their positions to silence and attack Minnesota citizens who want to keep their freedom.

America’s first Muslim Congressman, Keith Ellison, represents the 5th District of Minnesota, which includes Minneapolis.  Ellison has been a vocal supporter of Hamas (CAIR) and the Muslim Brotherhood. Congressman Ellison is actively working to silence any criticism of Islam or jihad here in the United States, and works directly with the first Islamic political party here, the U.S. Council of Muslim Organizations.

Minnesota Governor Mark Dayton made his position clear when he told citizens of that state if they do not like the growing Muslim Somali population in Minnesota they can leave.

Lieutenant Governor Tina Smith is a hard-left Marxist who was the former Vice President of Planned Parenthood for Minnesota and the Dakotas.

Both Governor Dayton and Lieutenant Governor Smith have forged a strong working relationship with Hamas (CAIR) in Minneapolis.

Minneapolis Mayor Betsy Hodges has bowed to the Islamic community, and advocates stopping “Islamophobia” instead of dealing with jihadi attacks in the United States and her state.

Under the watch of Hennepin County Sheriff Rich Stanek, the jihadi threat has increased exponentially. There are 83 Islamic Centers/masjids/mosques and Islamic Societies in Hennepin County. Sheriff Stanek has refused briefings on the threat from UTT, yet works with jihadis in the community.

In March 2016, Sheriff Stanek and other law enforcement organizations from around Minneapolis hosted the jihadi community in the Hennepin County Public Safety Office.  The message to the Muslims was that the law enforcement community would protect Muslims from “hate crimes and backlash” despite the fact FBI Criminal data shows no such threat exists in the U.S.   Yet, despite the threat from increasing jihadi attacks, including the recent stabbing by a Muslim jihadi in a mall in St. Cloud on September 17, 2016, numerous Muslims are being recruited in Minneapolis for terrorist groups, and no measures have been taken by the Sheriff to deter the threat other than outreach to the Muslim community.

And…citizens in Minnesota voted for these people.

It is worth noting that Minneapolis City Councilman Abdi Warsame from Somalia moved to rename three streets in Minneapolis to Somali names since a large portion of Minneapolis is now Somali.

Of all the officials in Minneapolis, the U.S. Attorney, Andrew Lugar, is the most egregious example of abuse of power.  Mr. Lugar does not pursue the jihadis in Minneapolis, he openly defends them and has publicly stated he will use the full authority of his office to stop “Islamophobia.”  Meaning, he will squash Minnesotans free speech rights to give cover to jihadis in Minneapolis.

Media

The media in Minneapolis, including the Star Tribune, the local CBS affiliate WCCO, Minnesota Public Radio and many others, are not interested in investigative journalism or the truth.  These media outlets propagate a hard-left/Marxist narrative that provides cover to the jihadis in Minnesota while keeping the public in the dark of the real dangers.

UTT provided these organizations evidence from the largest terrorism financing and Hamas trial ever successfully prosecuted in U.S. history revealing CAIR was created by the U.S. Muslim Brotherhood’s Palestine Committee (Hamas) to be a Hamas organization here in America.  Yet, while they called for UTT’s programs to be shut down in Minnesota, they openly defend Hamas (CAIR) and never mention any of the evidence from the FBI or Department of Justice detailing CAIR is a terrorist organization.

CVE Gets Minnesota Coming and Going

The Countering Violent Extremism or CVE is a program created in Britain by the Muslim Brotherhood.   This is a hostile information campaign and a double-agent program, and was eagerly sought after by the U.S. government.  CVE’s purpose is to ensure Muslim Brotherhood leaders are exclusively used by the government as the liaison for all matters pertaining to Islam and terrorism, so the MB controls the narrative in this war.

In Minnesota, the Islamic leadership took this to a new level when President Obama used Minneapolis as a CVE pilot city.   The Muslim community not only uses CVE to control the counterterrorism efforts in Minneapolis/St. Paul, they are now bashing Minnesota’s leaders for the “Islamophobia” of CVE.  It is a self-sustaining circular thrashing of Minnesota’s leadership for doing what the Muslim community asked them to do.  Classic counterintelligence tactics.

Other Noteworthies

Moreover, since Congresswoman Michele Bachmann (6th District, 2007-2015) began courageously defending the state of Minnesota against the jihadi onslaught, the federal government has poured tens of thousands of Somali refugees into Minnesota.  The Southern Poverty Law Center and the Department of Justice filed lawsuits against her high school – Anoka – for “harassment” of lesbian and gay students.  This is exactly the kind of targeted attack that is typical of the Marxist movement in support of jihadis across the United States.

Summary

UTT’s assessment the Twin Cities are lost is based on:

1. The significant Islamic jihadi network.
2. The support the jihadis have from all levels of the government in Minneapolis, as well as the Governor and Lieutenant Governor.
3. A complicit media.
4. Minnesota citizens are nearly completely unaware of the threat or willfully complacent.
5. Law enforcement leadership is either defending the jihadis or denying there is a counterintelligence issue.
6. Pastors and rabbis sit silently.

If Minnesota is to retake its capital city and survive this war, it is the Sheriffs and Pastors who must be pressed by the citizens to do their duties.  The situation in Minnesota, as in the United States in general, constitutes an insurgency. In the counter-insurgency, Minnesota must be retaken County by county.   Citizens must ensure their law enforcement officers/deputies are knowledgeable and trained, and their pastors are fit for the pulpit.  If the people are to be energized, courageous Pastors must speak truth in love to the growing threat to Minnesota.

Riot police clash with protesters at Hong Kong airport as Chinese forces mass at border

Police armed with batons and pepper spray have clashed with thousands of protestors at Hong Kong’s international airport after they blockaded the departures area of the busy international hub, forcing flights to be suspended for a second day.

After a day of largely peaceful protests, marked mostly by arguments between demonstrators and frustrated travellers, violence broke out between riot police and demonstrators after nightfall.

Ms Jaitt shot to fame in Europe after travelling to Spain from Argentina to find her fortune with just ten dollars in her pocket. Soon she was socializing with some of the wealthiest and most powerful people on the planet — and learning their secrets.

In 2018 the mother of two young children accused high-level politicians, sports stars, and entertainers of being involved in an international “evil beyond your worst nightmares” pedophile ring that systematically kidnaps children before plunging them into a life of depravity and ritual rape and torture.

This is a message that began being forwarded via email in the mid-1990s of various Bill and Hillary Clinton associates alleged to have died under mysterious circumstances. This conspiracy theory continued to resurrect itself during Hillary Clinton’s 2008 and 2016 presidential bids.

1- James McDougal – Clintons convicted Whitewater partner died of an apparent heart attack, while in solitary confinement. He was a key witness in Ken Starr’s investigation.

2 – Mary Mahoney – A former White House intern was murdered July 1997 at a Starbucks Coffee Shop in Georgetown .. The murder …happened just after she was to go public w:th her story of sexual harassment in the White House.

3 – Vince Foster – Former White House counselor, and colleague of Hillary Clinton at Little Rock’s Rose Law firm. Died of a gunshot wound to the head, ruled a suicide.

4 – Ron Brown – Secretary of Commerce and former DNC Chairman. Reported to have died by impact in a plane crash. A pathologist close to the investigation reported that there was a hole in the top of Brown’s skull resembling a gunshot wound. At the time of his death Brown was being investigated, and spoke publicly of his willingness to cut a deal with prosecutors. The rest of the people on the plane also died. A few days later the Air Traffic controller commited suicide.

5 – C. Victor Raiser, II – Raiser, a major player in the Clinton fund raising organization died in a private plane crash in July 1992.

6 – Paul Tulley – Democratic National Committee Political Director found dead in a hotel room in Little Rock , September 1992. Described by Clinton as a “dear friend and trusted advisor”.

7 – Ed Willey – Clinton fundraiser, found dead November 1993 deep in the woods in VA of a gunshot wound to the head. Ruled a suicide. Ed Willey died on the same day his wife Kathleen Willey claimed Bill Clinton groped her in the oval office in the White House. Ed Willey was involved in several Clinton fund raising events.

8 – Jerry Parks – Head of Clinton’s gubernatorial security team in Little Rock .. Gunned down in his car at a deserted intersection outside Little Rock Park’s son said his father was building a dossier on Clinton He allegedly threatened to reveal this information. After he died the files were mysteriously removed from his house.

9 – James Bunch – Died from a gunshot suicide. It was reported that he had a “Black Book” of people which contained names of influential people who visited prostitutes in Texas and Arkansas

10 – James Wilson – Was found dead in May 1993 from an apparent hanging suicide. He was reported to have ties to Whitewater..

11 – Kathy Ferguson – Ex-wife of Arkansas Trooper Danny Ferguson, was found dead in May 1994, in her living room with a gunshot to her head. It was ruled a suicide even though there were several packed suitcases, as if she were going somewhere. Danny Ferguson was a co-defendant along with Bill Clinton in the Paula Jones lawsuit Kathy Ferguson was a possible corroborating witness for Paula Jones.

12 – Bill Shelton – Arkansas State Trooper and fiancee of Kathy Ferguson. Critical of the suicide ruling of his fiancee, he was found dead in June, 1994 of a gunshot wound also ruled a suicide at the grave site of his fiancee.

13 – Gandy Baugh – Attorney for Clinton’s friend Dan Lassater, died by jumping out a window of a tall building January, 1994. His client was a convicted drug distributor.

14 – Florence Martin – Accountant & sub-contractor for the CIA, was related to the Barry Seal, Mena, Arkansas, airport drug smuggling case. He died of three gunshot wounds.

15 – Suzanne Coleman – Reportedly had an affair with Clinton when he was Arkansas Attorney General. Died of a gunshot wound to the back of the head, ruled a suicide. Was pregnant at the time of her death.

16 – Paula Grober – Clinton’s speech interpreter for the deaf from 1978 until her death December 9, 1992. She died in a one car accident.
17 – Danny Casolaro – Investigative reporter, investigating Mena Airport and Arkansas Development Finance Authority. He slit his wrists, apparently, in the middle of his investigation.

18 – Paul Wilcher – Attorney investigating corruption at Mena Airport with Casolaro and the 1980 “October Surprise” was found dead on a toilet June 22, 1993, in his Washington DC apartment had delivered a report to Janet Reno 3 weeks before his death.

19 – Jon Parnell Walker – Whitewater investigator for Resolution Trust Corp. Jumped to his death from his Arlington ,Virginia apartment balcony August 15, 1993. He was investigating the Morgan Guaranty scandal.

20 – Barbara Wise – Commerce Department staffer. Worked closely with Ron Brown and John Huang. Cause of death: Unknown. Died November 29, 1996. Her bruised, naked body was found locked in her office at the Department of Commerce.

21 – Charles Meissner – Assistant Secretary of Commerce who gave John Huang special security clearance, died shortly thereafter in a small plane crash.

22 – Dr. Stanley Heard – Chairman of the National Chiropractic Health Care Advisory Committee died with his attorney Steve Dickson in a small plane crash. Dr. Heard, in addition to serving on Clinton ‘s advisory council personally treated Clinton’s mother, stepfather and brother.

23 – Barry Seal – Drug running TWA pilot out of Mena Arkansas, death was no accident.

24 – Johnny Lawhorn, Jr. – Mechanic, found a check made out to Bill Clinton in the trunk of a car left at his repair shop. He was found dead after his car had hit a utility pole.

25 – Stanley Huggins – Investigated Madison Guaranty. His death was a purported suicide and his report was never released.

26 – Hershell Friday – Attorney and Clinton fundraiser died March 1, 1994, when his plane exploded.

27 – Kevin Ives & Don Henry – Known as “The boys on the track” case. Reports say the boys may have stumbled upon the Mena Arkansas airport drug operation. A controversial case, the initial report of death said, due to falling asleep on railroad tracks. Later reports claim the 2 boys had been slain before being placed on the tracks. Many linked to the case died before their testimony could come before a Grand Jury.
